1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and QuickSnap ("Company," "we," "us," or "our") governing your use of the KAMP mobile application and related services (collectively, the "Service").

By creating an account, accessing, or using KAMP, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

KAMP is a personal finance management application designed to help users:

• Track income and expenses through manual transaction entry
• Create and manage budgets across various spending categories
• Set and track savings goals
• Monitor recurring subscriptions
• View financial insights and spending analytics
• Earn achievements and participate in financial challenges (gamification features)
• Receive notifications for budget alerts and financial milestones

3. Eligibility

To use KAMP, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• If under 18, have parental or guardian consent to use the Service
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using KAMP, you represent and warrant that you meet all eligibility requirements.

4. Account Registration and Security

4.1 Account Creation

To access most features of KAMP, you must create an account by providing accurate and complete information, including:

• Your full name
• A valid email address
• A secure password

You agree to keep your account information current and accurate.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your device is secured with appropriate passcode or biometric protection

4.3 One Account Per User

Each user may maintain only one KAMP account. Creating multiple accounts may result in termination of all accounts.

5. Subscription and Payments

5.1 Free and Premium Features

KAMP offers both free and premium subscription tiers:

5.2 Free Trial

New users may be eligible for a 7-day free trial of premium features. After the trial period, you will be charged according to your selected subscription plan unless you cancel before the trial ends.

5.3 Subscription Terms

• Subscriptions are billed in advance on a monthly or annual basis
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through your account settings
• No refunds are provided for partial subscription periods

5.4 Price Changes

We reserve the right to change subscription prices. You will be notified at least 30 days before any price change takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Acceptable Use Policy

6.1 Permitted Use

You may use KAMP solely for personal, non-commercial financial management purposes in accordance with these Terms.

6.2 Prohibited Conduct

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means (bots, scrapers) to access the Service
• Transmit viruses, malware, or other harmful code
• Impersonate another person or entity
• Use the Service to harass, abuse, or harm others
• Share your account credentials with third parties
• Use the Service to launder money or engage in fraudulent financial activities
• Circumvent or manipulate the gamification system

7. User Content

7.1 Your Content

You retain ownership of all content you submit to KAMP, including transaction data, budgets, goals, receipt images, and profile information ("User Content").

7.2 License Grant

By submitting User Content, you grant us a limited, non-exclusive, worldwide license to use, process, and store your content solely for the purpose of providing and improving the Service.

7.3 Content Responsibility

You are solely responsible for the accuracy and legality of your User Content. We do not verify the accuracy of financial data you enter.

7.4 Data Export

You can export your User Content at any time through the app settings in JSON format.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, graphics, and branding (excluding User Content), is owned by QuickSnap and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or distribute any part of the Service
• Use our trademarks, logos, or branding without written permission
• Create derivative works based on the Service
• Remove any copyright or proprietary notices

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Financial Advice

9.3 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or reliability of:

• Financial calculations, projections, or insights generated by the Service
• Data synchronization or backup processes
• Third-party services integrated with KAMP

9.4 Service Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend or discontinue any part of the Service at any time without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL QUICKSNAP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR KES 5,000, WHICHEVER IS GREATER
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR FINANCIAL DECISIONS MADE BASED ON THE SERVICE

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless QuickSnap and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any financial decisions you make based on information from the Service

12. Termination

12.1 By You

You may terminate your account at any time by:

• Using the account deletion feature in app settings
• Contacting our support team

Upon termination, your data will be deleted in accordance with our Privacy Policy.

12.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You breach these Terms
• We suspect fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your User Content
• Provisions that by their nature should survive termination will survive (including disclaimers, limitation of liability, and indemnification)

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending you a notification through the app
• Requiring acknowledgment of updated Terms upon next login

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and QuickSnap regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, government action, or system failures.
